Brother Impregnates Minor Sister, Kerala HC Allows Abortion of 32-Week Pregnancy

Kochi: A 15-year-old minor girl was impregnated by her own brother in Kerala. She is now pregnant with an over 32-week-old fetus in her womb. The Kerala High Court on May 19, allowed medical termination of pregnancy of this minor girl stating that social and medical complications are likely to arise if abortion was not permitted.

Justice Ziyad Rahman said, “Considering the fact, the child is born from his own sibling, various social and medical complications are likely to arise. In such circumstances, the permission as sought by the petitioner to terminate the pregnancy is inevitable. ”

As per medical reports, the court found that the child was physically and mentally fit for medical termination of pregnancy. The court also stated that the continuation of pregnancy is likely to cause grave injury to the social and mental health of the child.

The court posted the matter to be taken up again a week from May 19. On the next date, a report regarding completion of the procedure has to be placed before the court, it said.
