Chennai: Even if she is a homemaker, a wife is entitled to an equal share in the property, said the Madras High Court on Saturday. The High Court clarified that the homemaker wife will have an equal share whether the property is purchased in either husband’s or wife’s name, it would be considered as their joint effort.
“The property might have been purchased either in the name of the husband or wife, nevertheless, it must be considered to have been purchased with money saved by their joint effort,” said Justice Krishnan Ramasamy of the Madras High Court.
The court held that the wife was entitled to half a share in the assets acquired by the husband.
Madras High Court made this remark while hearing a 2016 case filed by an estranged couple who got married in 1965. The husband, who has meanwhile died, had accused his wife of usurping property and also alleged that she had an extramarital affair.
After her husband’s death, their children filed a case where the court declared that homemakers are entitled to an equal share in the property.
