Supreme Court Stays 3rd Term Extension of ED Director

New Delhi: The Supreme Court on Tuesday stayed an order of the Central Government granting a third term extension to Enforcement Directorate director, Sanjay Kumar Mishra.

The apex court termed this third-term extension order “illegal”. In its order, the Supreme Court said the extension for the third time is invalid under the law.

The tenure of the present Enforcement Directorate director, Sanjay Kumar Mishra, which was extended twice earlier, will end on July 31, 2023.

The Supreme Court also pointed out that the Central Government does not hold the power to extend the tenure of the ED director for a third term.

But the Supreme Court affirmed the amendments in the DSPE and CVC Act, giving the Centre the power to extend the tenure of a CBI chief and ED director by a possible 3 years beyond their mandatory two-year term.
