Review Petition Filed After Supreme Court’s Same-Sex Marriage Denial

New Delhi: In response to the Supreme Court’s recent decision to deny legal recognition to same-sex marriages, a review petition has been filed by Udit Sood, one of the petitioners in the case. On October 17, the Supreme Court unanimously ruled that the authority to enable legal recognition of same-sex marriages lies with Parliament, stating that there is no fundamental right to marry.

Chief Justice of India DY Chandrachud and Justice Sanjay Kishan Kaul, however, voiced their support for recognizing same-sex partnerships and emphasized the need for anti-discrimination laws to protect the rights of LGBTQIA+ individuals.

While the five-judge bench did not reach a consensus on adoption, civil union, and recognition for queer couples, a 3:2 majority decision ruled against adoption in four separate judgments. Additionally, the Supreme Court directed the government to establish a committee tasked with examining the rights and entitlements of individuals in queer unions, even without legal recognition of their relationships as “marriages.”
