EWS Reservation to Continue, SC Upholds 10% EWS Reservation Act

New Delhi: The Supreme Court of India on Monday upheld the 10% quota for the Economically Weaker Sections (EWS)), in government jobs and educational institutions. The apex court stated that this reservation is neither discriminatory nor does it change the fundamental framework of the constitution.

The judges ruled that the EWS quota did not go against the Constitution.

A five-judge bench was hearing the matter. Four judges upheld the act while one of them passed dissenting judgement against the act.

The EWS reservation was implemented just before the 2019 general election, to aid economically marginalised groups in Indian society.

The Centre approved the 103rd constitutional amendment for this reservation in January 2019, not long after the ruling BJP lost the elections in Madhya Pradesh, Rajasthan, and Chhattisgarh. This was immediately contested in the Supreme Court.
