Cautious Optimism From CJI DY Chandrachud on Probe Agencies’ Reach

New Delhi: In his keynote address at the 20th D P Kohli Memorial Lecture, Chief Justice of India (CJI) D Y Chandrachud emphasized the crucial need for a delicate balance between the search and seizure powers of investigative agencies like the Central Bureau of Investigation (CBI) and an individual’s right to privacy. He highlighted that maintaining this equilibrium is fundamental to fostering a fair and just society within the realm of criminal justice.

CJI Chandrachud highlighted the importance of upholding due process, asserting that unwarranted confiscation of personal devices should be avoided. He urged investigative agencies to prioritize their efforts, focusing on crimes that pose significant threats to national security, economic well-being, and public order, rather than spreading resources thinly across various cases.

Furthermore, the CJI stressed the necessity for law enforcement agencies, particularly the CBI, to enhance their capacities and leverage Artificial Intelligence (AI) tools to address the evolving landscape of crime. He emphasized the rapid pace at which crime is evolving, particularly in the digital realm, necessitating innovative solutions and adaptability from investigative agencies.

As our world becomes increasingly interconnected through digital technologies, including cybercrime and digital fraud, law enforcement agencies like the CBI must adapt to confront new and complex challenges effectively. CJI Chandrachud concluded by emphasizing the importance of investigative agencies keeping pace with the radical changes in crime.
