Marriage not to be proved by marriage certificate of Arya Samaj Temple alone: ​​High Court

New Delhi: Arya Samaj temple marriage certificate is not enough to prove marriage. The Allahabad High Court made this comment during the hearing of an appeal. Additionally, the High Court dismissed a petition filed by a man to bring back his wife. Petitioner Bhola Singh submitted the marriage certificate issued by the Arya Samaj Temple as evidence.

The petitioner alleged in the court that the corpus is the petitioner’s wife. Along with this, he deposited the marriage certificate in the court of Arya Samaj Temple Ghaziabad and presented some photos.

The High Court said, “This court and other High Courts have questioned the marriage certificate issued by the Arya Samaj Society.” The court observed that Arya Samaj was abusing the trust by organizing marriages without considering the authenticity of the certificates. The court said that since the marriage was not registered, it cannot be presumed that both parties were married based on the Arya Samaj temple certificate.

A division bench of Justice Saurabh Shyam Shamsheri said, “There are other options available to the petitioner under the criminal and civil laws.” Therefore, the writ petition is not admissible in the present case for wrongful direct action.
