Army will be entitled to disability pension only if the incident happened in the time of duty: Supreme Court

The Supreme Court, in one of its decisions regarding the Army Disability Pension, said that the jawans will be entitled to disabled pension only if they have become disabled during the duty.

The court said that if the army is on leave and during that time he gets disability due to some reason, then he will not be entitled to this pension. The court also mentioned that the army cannot get disability pension if the disability is less than 20 percent. An army can be entitled to disability pension only if there is more than 20% of disability.

A bench of Justice Abhay S Oka and Justice MS Sundaresh were hearing in the court. In the court, the order of Armed Forces Tribunal was challenged by the Central government in which it was ordered to give disability pension to the army. The court said in its decision that disability pension can be given to the army only if his injuries are related to duty.
