Telecommunications Bill Tabled in Lok Sabha to Overhaul Archaic Indian Telecom Laws

New Delhi: The draft Telecommunications Bill, 2023 was tabled in the Lok Sabha on Monday, granting the government authority to assume control, manage, or suspend telecommunication services for national security reasons. This legislation aims to modernize the 138-year-old Indian Telegraph Act governing the telecom sector and was approved by the Cabinet in August.

Notably, the draft bill extends its scope to include over-the-top (OTT) services like internet-based calling and messaging apps within the telecommunications definition, emphasizing user safety. Addressing industry concerns, the bill proposes adjustments to the powers of the Telecom Regulatory Authority of India (Trai), with officials asserting resolution before Cabinet approval.

Among the proposed changes, the draft bill seeks to streamline rules, facilitating the refund of fees upon a company surrendering its permit. Additionally, it empowers the government to waive entry fees, license fees, penalties, etc., in the interest of consumers, competition, telecom network availability, and national security.

This comprehensive Telecommunications Bill, 2023, reflects a concerted effort to align regulatory frameworks with contemporary technological landscapes while prioritizing security and consumer interests.
