PIL To Remove Arvind Kejriwal From Post Of Delhi CM Filed In Delhi High Court

New Delhi: A PIL has been filed before the Delhi High Court seeking the removal of Arvind Kejriwal from the post of Chief Minister of Delhi. The petitioner, Surjit Singh Yadav, a Delhi resident identifying as a farmer and social worker, asserts that Kejriwal’s recent arrest by the Enforcement Directorate (ED) in connection with a liquor policy case disqualifies him from holding public office.

Yadav argues that Kejriwal’s continuation as Chief Minister during his incarceration would impede due legal process and potentially disrupt constitutional order. Citing constitutional provisions, Yadav contends that Kejriwal’s arrest renders him unable to fulfill his duties as a public servant, thus warranting his removal from office.

The petitioner raises concerns about Kejriwal’s ability to conduct government affairs from prison, highlighting potential breaches of confidentiality and conflicts of interest. Yadav also points to the Transaction of Business rules, suggesting that Kejriwal’s involvement in decision-making could compromise legal proceedings against him.

In response, AAP ministers have indicated that Kejriwal intends to remain in office and govern from prison if necessary.

Yadav’s plea calls for a writ of Quo Warranto, compelling Kejriwal to justify his continued tenure as Chief Minister and, if deemed appropriate, his removal from office.
